Who you’re dealing with:
DigiTLC Pty Ltd (ABN 69 646 587 911) provides DigiSyncro as a subscription service. You are the “Customer”.

What you’re buying:
DigiSyncro is a Software as a Service platform offered in tiers (Core, Plus, Max, Pro AI, and Pro AI Addon).
Each tier has different features and pricing.

How you can use it:
You can use DigiSyncro for your own business while your subscription is active and paid.
You can’t resell it, transfer it, or share access outside your business.

Setup and configuration:
Your subscription includes software access and support.
Where AI Agent setup is included, it covers only the AI Agent (phone or chat depending on your plan) and standard actions like capturing details,
notifications and escalation.
Other setup (websites, forms, calendars, pipelines, automations, integrations, reporting, etc.) is your responsibility unless we agree in writing
to provide paid configuration services.

Minimum term and renewals:
Monthly plans have a 90-day minimum term. Annual plans have a 365-day minimum term.
Subscriptions renew automatically (monthly or annually). We don’t send renewal reminders.

Fees, usage charges, and credits:
Your plan fee is billed in AUD on the monthly or annual anniversary of your start date.
Some add-on usage may be billed monthly in USD to your saved card.
If your plan includes monthly credits, they are used first, then additional usage is billed to your card.

No refunds / pauses:
We don’t offer refunds, holds, or pauses (except where required by law). If you stop early, fees still apply as outlined in the full terms.

Late payments:
If payments are late, access may be restricted until your account is brought up to date. Late fees/interest may apply as allowed by law.

How to cancel:
To cancel, you must give 30 days’ written notice and complete the minimum term.
For monthly plans, cancellation takes effect on the next monthly renewal date after the notice period ends.
For annual plans, cancellation takes effect on the next annual renewal date after the notice period ends.
Fees due during the notice period still apply.

Your data after cancellation:
You can request your data within 30 days after the termination date. After that, data may be deleted unless otherwise agreed.
Exports depend on what the platform technically supports.

Transfers to another GoHighLevel provider (if requested):
DigiSyncro’s system, templates, workflows, and configurations are proprietary and not transferable.
If you request a move to another GoHighLevel provider, we may agree to assist at our discretion and only where technically possible.
If agreed, a transfer/migration fee (plus any third-party costs) applies and must be paid in advance.

Third-party services:
Some functions rely on third-party providers (e.g. SMS, integrations, API services). We are not responsible if third parties change,
experience downtime, suspend services, or discontinue features.

Fair use and compliance (SMS + AI):
You must use DigiSyncro legally and responsibly, including obtaining consent where required and providing opt-out options for marketing.
We may restrict or suspend service if there is abuse (e.g. spam, excessive SMS use, illegal activity, or misuse of AI).

Security, privacy, and responsibility:
We take reasonable steps to protect data and comply with applicable privacy laws. You are responsible for the data you upload and how you use the system.

Disputes and changes:
If there’s a dispute, we’ll try to resolve it through discussion and mediation first.
We may update terms from time to time, and continuing to use the service after an update means you accept the updated terms.
